Clause 12 is the relevant one here.
You say £900 and they say £2000. What was the purchase amount originally?
How it it fair for the TA to charge £2000 to customer if there is a shortfall, but gets to keep the £2000 if it's over, there has to be a balance
You either have to say, any difference of exchange rate will be deducted or returned, by A} the customer or B} the TA
They can't have it both ways.

Hi, I need help please. Booked a fly cruise through a 3rd party independent travel agent (marella cruise) in February 2020. Paid cash. The cruise was cancelled in mid March and to date I have still not received my refund despite Tui promising to do all refunds by the end of September. I have e mailed the agent on numerous occasions but not getting anywhere. What could be my next step? Legal route? I would need help doing this if this is the case. Is there anyone to help me please.0
