I am due to go on holiday in September with 4 friends, assuming social distancing measures will still be in place this will make the holiday impossible as we will be sharing a holiday cottage. Any advice welcome

I think you may inadvertently posted your question on an unconnected thread. Perhaps see if another exists that better fits your question, or if not, start a fresh one.

I am struggling to find who mediate in this situation. My Travel Insurance don't want to get involved and the Tour Operator won't budge. Cape Tours are ATOL protected, but that appears to be useless in the situation. Any thoughts?
    What did the trip involve?

Clause 12 is the relevant one here.

You say £900 and they say £2000. What was the purchase amount originally?
With refunds I can't see that clause standing up to the fairness test.
How it it fair for the TA to charge £2000 to customer if there is a shortfall,  but gets to keep the £2000 if it's over, there has to be a balance
You either have to say, any difference of exchange rate will be deducted or returned,  by A} the customer or B} the TA
They can't have it both ways.

  • Hi, I need help please. Booked a fly cruise through a 3rd party independent travel agent (marella cruise) in February 2020. Paid cash. The cruise was cancelled in mid March and to date I have still not received my refund despite Tui promising to do all refunds by the end of September. I have e mailed the agent on numerous occasions but not getting anywhere. What could be my next step? Legal route? I would need help doing this if this is the case. Is there anyone to help me please.

Bit of an odd thread to hijack, tbh. Start your own thread. Its easy enough to start a small claims court action.
