    only a judge can tell you the answer to that question, in court

    but if this thread is currently about a set aside, concentrate on that , because that is all a judge will be concentrating on, the set aside hearing wont deal with the signage or initial pcn or court claim

    a set aside hearing is about granting a set aside based on the reasons being put forward for setting it aside, like papers going to the wrong address for example, nothing to do with the pcn , signage , landowner contract or original court case

    too often people concentrate on what led them to this point , instead of concentrating on the set aside process, dont be one of them , which is what coupon mad told you less than 3 hours ago

    1) Can someone advise what  a Foir is , ive googled and checked and cant seem to find- I didn't change my V5 until this year, however i changed my license and everything else, and other agencies such as car insurance were able to locate my new address.
    2) Also in my Sar i received It only shows one letter being sent which is the first letter of the original parking ticket - No other letters , so only one ion the 14th June 2018- no others regarding court

    That's odd.   A SAR should flush out more letters and you'd expect an attempt to check the address, as required before filing a claim. 

     Show the Judge that the Claimant's SAR suggests they handed the data to a third party and never made any further address checks themselves before launching a claim to an old DVLA address which are known to be unreliable, due to the DVLA's in-house failure to operate a 'tell-us-once' service that people expect to be the case when they send off their driving licence. 

    The DVLA told me when I raised this with them, that they can't ''because it's a different Department''.  To say I was shocked and angry was an understatement. How DARE they treat data subjects so shoddily yet hand over data that I would argue they KNOW is likely to be wrong, because they know the data subject has moved (from their driving licence).

    So bad is the effect of the DVLA failure (and I do lay it at their door) that the court service and Government had to step in:

    They can only access DVLA once to get the keepers data. So if there's a crossover they'll never know unless they are told, by the person they're trying to contact if they ever find out, or if mail is returned to sender.

    At what point does the address the DVLA hand out become a "reason to believe" that it's no longer lived at when there's no response ?

    In paragraph 5, Shapla Begum states that at the time of the alleged event, the claimant was a member of the IPC, yet the image of the yellow and black sign quite clearly states UKPPO were BPA members. Therefore Shapla Begum's statement is therefore false.
