Hi,

I am looking for advice.

A family member sent a claim away without knowledge to The Claim guys.

I recently received a cheque for £1000 from a loan I had years ago but it was a joint loan so I assumed my ex had made a claim so I cashed the cheque. I didnt think anything else if it however got a threatening email and letter from the claim guys today advising me if I dont pay the £500 fees they will take me to court and issue me a CCJ etc. I didn't fill in any forms to them or sign anything.

What can I do?

Any help would be greatly appreciated

    Tell them you didn't employ them and they need to ask your ex for the fee.

    He didnt tho. That's what I thought had happened when I received the cheque out the blue. They say it's my signature on the paperwork etc all electronic tho. So I'm assuming its been a family member asking it for me.

    If you've received £1000 in redress why is the fee fully half of that?  :open_mouth:

    I'm guessing because the ex got the other half - so it's 25% (or more accurately 24%).

    OP - you need to ask for evidence of the contract you signed with them.

    So I'm assuming its been a family member asking it for me. 

    1 - Don't assume that.  There have been reports of CMCs submitting cases without authorisation.  (not saying it is the case here, just that it has happened elsewhere)

    2 - Even if a family member did it, you are not liable for the contract.


    Is it possible that your ex made the complaint via the claims company?  If so, you are not liable for their fee as you never employed them.
