Hi,
i have received a letter about severe premium disability for my son.
we had to go to a tribunal and was successful. Received all backpay.
it says people who live alone are entitled but he lives with me, I also receive the daily care benefit. Would he not be entitled. It’s all quite confusing. Thank you in advance

SDP is paid with other income related benefits, however as he doesn't live alone he wouldn't qualify unless the person he lives with also in receipt of PIP/DLA, also if someone receives carers allowance then SDP won't apply.
So when you say you receive "daily care benefit" is that PIP.?0 -
Hi, yes that’s pip. It’s just me and him that live together. Nobody claims carers allowance even though we have help from family0

As you're claiming the daily living part of PIP for yourself then yes your son will be entitled to the SDP in with his ESA. Although the criteria is that you must live alone BUT if you live with any other adults they must also be claiming a qualifying benefit such as PIP daily living and you. The quickest way to claim the SDP is to ring ESA and apply over the phone, if you can get through. It will be back dated to the start of his PIP award, if the other criteria applied at the time.Don't claim Carers allowance for looking after him because if you do then he won't be entitled to the SDP.1

That's brilliant. Thank you very much. Does it take long to be awarded? The backpay from PIP took quite a long time, around 2 months after winning the tribunal

If you ring it can take less than a week BUT it may take a little longer due to currant circumstances. If you apply by post with filling out the form it can take about 1 month. It's a very simple application. It pays an extra £66.95 per week. Slightly less than that before the April benefit increase.
