Crash on Mini roundabout who’s at fault

Hi,
Hoping someone on hear can help, I was turning right at a mini roundabout (only one lane going right) I was in the right hand lane indicating right to take the third exit and there was one car behind me. They then overtook me on the roundabout by driving the wrong way around the roundabout and I hit their car as I didn’t have time to react, they are claiming it is my fault surly I’m not at fault hear? I know roundabouts are a complicated area when it comes to liability but I would have thought purely based on the fact I was on the roundabout first would negate any liability on my part not to mention the dangerous overtake!!

    Thanks for the reply, there is a CCTV camera positioned next to the roundabout monitored by the council. however it pans round so may not have caught the collision.

    Accidents on roundabouts often go 50/50 due to "he said, she said".
    However, overtaking by driving the wrong side of a mini roundabout is clearly not the actions of a careful and competent driver, and not something that most people would anticipate, so I'd have thought that if you can prove it it would be much more in your favour. I wouldn't be surprised if it wasn't found to be 100% their fault though....


    On a straight road, if you indicate right, move to the centre of the road and slow for the turn, then some idiot overtakes you as you are turning and you hit them it is still somehow partially your fault, as a competent driver can apparently operate the controls, check where they are going and simultaneously watch the mirrors for someone overtaking despite the signal, road position and slowing down. :o 

    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    (except air quality and Medical Science ;))

    You were in the RH lane approaching a two-lane "mini" r'a'b... Indicating right... And they drove the wrong way round the r'a'b, and you hit them?

    That would seem to be fairly clear-cut. IF you can prove it.

    Because I'll take a bet that their version is they were in the RH lane, you were in the LH...

    how many exits were there ?
    you were indicating right to take the second exit (so i assume 1 entry, 2 exits)

    Thank you for pointing out my mistake it was the 3rd exit I was leaving at not the 2nd.

    Decent photos, google earth, streetview, drawings of events etc and you will win hands down.  'Straightening' mini roundabouts is an offence.

    Simply state the other driver broke rule 188.

    Mini-roundabouts. Approach these in the same way as normal roundabouts. All vehicles MUST pass round the central markings except large vehicles which are physically incapable of doing so.

    What do you mean "wrong way round the roundabout"? I woild assume that means they were on the right of the roundabout in the lane/s for on coming traffic. If there was a collision it would be damage to your driver side and their passenger side, is this correct?
