not sure if this is the correct forum , but I will as anyway
if you have a default , and its sold to the likes of Lowells , who then (at 5 yrs) start CC action and you are issued with a CCJ , how long can lowells/bailiffs continue to chase for monies
is there a set point where a "warrent" runs out , or a point where they are refused a warrant , or in theory can they chase you till 2050
I know about the 6 yr type rule for starting CC action , however this is further down the line

They can chase you for as long as they wish0

sorry , can you clarify
"They can chase you for as long as they wish"
is it the fact that it has been sent to a bailiff , or the fact that a ccj exists ?
I note on many other posts where people say "ccj issued to old addtess "x yrs" ago , the answers seem to be , "let it disappear from your file "
"They can chase you for as long as they wish" and Indefinitely.yes I am aware they can write to you , send you xmas cards for many many yrs , and in most cases a court will turn round and say "tough you had 6 yrs to enforce"
my question was regarding the lengh of legality of a county court warrent , and the ability to legally enforce it

No warrents for debt, its a county court judgement, CCJ`s do not go statute barred, but, a court would expect the creditor to act on that judgement within a period of 6 years, if they do not do so, and then wish to further enforce that judgement, they must go back to the court and seek its permision to do so.They must have good reason why enforcement action was not taken within the first 6 years, or the court may refuse permision, this is according to the Limitation Act.The Limitation act see`s to it that even with a CCJ, an individual cannot be chased forever for debt.

ok thanks for replying , I did not know that ccj,s did not go statute barred , i realise now that its the actual default that goes statute barred
after the CCJ "creditor to act on that judgement within a period of 6 years," so this 6 yrs , is that from date of ccj or date of default ?
ie , if a company wait 5 yrs and 9 mths from default , then get a default default , thru changing address etc , can you (legally) be sent a letter from bailiffs office 7 yrs from default date ?

They obtained the judgement against you on a given date.
The court expects them to take enforcement action within six years of obtaining judgement against you.
The court doesn't care when the creditor defaulted your account, they weren't involved in that.0 -
thank you
so, in theory
a person , say a private parking co , could issur a ticket back in 2012 , take you to court in your absence on 2018 * , and in 2024 a leter could arrive from a bailiff giving you 1 week to pay up or goods removed?
* a private parking co are only allowed to ask the dvla once for your name and address , this must be done within 14 days of a ANPR "hit"1 -
If this is about a parking fine, you should ask on the appropriate forum.

no its not , i gave the example above as a "in theory" question
is my statement true ? , can a person that has been issued a ccj in there absence some say 5 yrs and 11 mths after incident , have a bailif knocking on his door demanding money or goods ,(with the courts backing) some 11 yrs and 11 mths after so called parking incident , or indeed a ccj being issued by a builder / plumber / newspaper shop etc , 11ys and 11 mths?0 -
In theory yes, but it depends on the circumstances, further enforcement costs money, money that may not be recouped from the debtor, for example, companies that obtain CCJ`s for consumer credit act debts, very rarely enforce these judgements further, as the cost ramps up, as i said, its all circumstance dependant.
