Forced annual leave whilst on furlough

If an employer has furloughed you until end of June (for now) can they force you to "handover" your annual leave entitlement during that period? This would mean the government is effectively paying 80% of your annual leave entitlement and you may not have any left when you do return to work? My firiend who works as a defence lawyer for a law firm has just been told this is what they (his company) are enforcing. Seems pretty sharp practice (in a nasty way) to me. I just wondered if they can get away with that?

Yes, they can dictate when you take leave, subject to giving enough notice. They will have to top you up to your full salary from the 80% level for those days on leave0

no idea. Are school holidays actually "leave" for teachers? Arent (some) teachers on odd contracts where they are only employed during term time but have their salary spread out over the whole year.Alter_ego said:
How might this apply to a schoolteacher from a private school who is furloughed? School holidays are within furlough.Andy_L said:

Why should a minimum of a weeks holiday be accrued while on furlough to take at another time. The fact that you view such practice as nasty suggests that you don't value having employment very highly. Without which one could have as much holiday as one wishes.smytha6 said:Seems pretty sharp practice (in a nasty way) to me. I just wondered if they can get away with that?0 -
Think if a law firm was doing it you could guess the chances are they can do it. They need to be paid 100% for the leave. They also need to give twice as long notice as they want the employee to take.
Why would companies want all the employees to take holidays when they are up and working again? The scheme is to protect jobs. Not to hinder companies further down the line.
