I purchased a new laptop on the 10/05/2020 from Argos, so that I could host an online quiz night for my family during this Lockdown via ZOOM. The old laptop I had I gave to my mum and grandma who live together so they could be involved. I tried to host the quiz night to some annoyance with the new laptop my picture looked laggy and a times froze while everyone else's looked fine. So I had to abandon the quiz, the day after I did the same again but this time I hosted with my Huawei mobile phone and my picture this time ran smooth with no problem.

So my questions is, am I within my rights to return the new laptop because it is not fit for the purpose I bought it. I have already contacted Argos online to explain my situation and the reply I got from them was because I'd opened the box and used it I wouldn't be able to return it has it had been used. But I had to use it and it was only after I'd used it that I realised it was fit for the purpose I'd bought it.

Below is the reply I got from Argos

Hi Darren, I am sorry to hear you're disappointed with the laptop. As the item has been used, we wouldn't be able to accept return of the item now unless the manufacturer deem the item faulty. We would always strongly recommend making use of out product pictures, reviews, descriptions and Q&A section to ensure you are purchasing an item you will be happy with. - Beth

Any advice would be greatful.

Thanks Darren

What Argos have stated is correct apart from this:
As the item has been used, we wouldn't be able to accept return of the item now unless the manufacturer deem the item faulty.
If you are rejecting the laptop and want a refund, Argos do have the right to ask you to prove that a fault exists and that the fault was there from the time you took possession of it but they can't insist that the manufacturer has to provide this proof.
There is no reason that you can't get a report from any suitably qualified IT supplier or repair place.
New computers often need a fair bit of "tweaking" before they start performing to a good level as there may well bit a fair bit of junk on there that can be deleted or disabled to speed it up.
Another point is that as you only bought it yesterday, there is a good chance that Windows and whatever else is loaded needs updating and it could well be doing this automatically, something that could easily slow it down a great deal.

Your best bet is to see exactly what is installed that you could do without and get rid of whatever you can and then make sure Windows is fully updated and then give it another go.
  • Hi, I've ran all windows updates and is now up to date. Its a new laptop so only Zoom and Kahoot app have been installed on it

This is far more likely to be your WiFi or internet connection
A mobile phone will require  far less bandwidth than a Laptop  so you are comparing apples with oranges
