Villa company won’t refund

Hi guys wonder if you can help or advise where we stand, there are 12 of us booked a villa through solmar villas they have our money and were due to go on 29th of May my friend booked all on her visa, however solimar have said they aren't willing to move or reimburse her or us for the holiday as in there eyes the villa is still available!! all be it all travel has been cancelled we don’t have flights which is fine but solimar say we can only get money back if we claim through our holiday insurance which all the party don’t have However my friend that booked does would it be her that could claim all the money back through her insurance as main payer? And If not what other options do we have to get reimbursed, I’ve contacted visa and due to it not actually being cancelled we can’t claim through that,any help will be appreciated guys!

Where is the villa?
Visa, credit card or debt card
Insurance would more than likely cover each person, so each person would be 1/12 of the cost.

The villa is in calpe, we have said we would be happy to move till next year or a credit voucher to use with them again but they aren’t for it, paid by Credit card one payment for the £2k0

How would the insurance company know? Surely if she booked it and paid it for instance say this was a present from her to everyone? For talk sake then surely it would be her that was coveted? I also don’t get how they can just say it’s our issue as the villa is available when there’s a world wide travel ban for non essential travel0

They will not be legally able to rent to you under current Spanish Lockdown rules for your date,
Theses rules might change as the Spanish Government needs support for the rules, so could change.
But if they stay the same, you will be able to prove that the villa is closed to overseas travelers, so are unable to fulfill the contract.
(even if you traveled to Spain, they can't let you stay)
So I think you would have a good chance (not certain) of getting your money refunded via the card.

Also the villa company said they could give us automated transactions on what we paid do you think we could say only 4 of us paid it all as in ones with insurance as it was a present for the other travellers n we just claim full amount each so my max is £750 for disruptive travel so get the villa company to put on invoice I paid £7500
