Nursery fees

My nieces nursery are still charging her for last month even though they were shut, they are now threatening her saying if she doesn’t pay her child’s place is in jeopardy, can they really do this? Surely they can furlough their staff and apply for the government grant! How can they expect payment for a total non service??

It’s a very grey area to be honest.
No she shouldn’t have to pay for a service she hasn’t received. Were they asking for full fees or a percentage rate of them.
They are however within their rights to terminate the place based on non payment. That part of a contract still stands....
Yes they can furlough their staff but they haven’t been allowed to claim the full 80% for them because they are in receipt of funding for the 2,3 and 4 year olds that qualify for the “free childcare” scheme. The problem with that is that they only receive just under £4 per hour per child for that and NMW is double that to pay their staff so they are currently operating at a loss.
