Partial Section 75 Claim?

Hi,

I had a family holiday booked to Florida for two weeks at start of May. The flights and hotel were booked through Virgin holidays, I've been offered a full refund from Virgin and given a cancellation invoice and, like many others, I'm now just waiting for the money.

My issue is with Disney/Universal theme park tickets I bought, these have a combined value of nearly £3000. I bought them through a third party company who at the time of purchase states they charge a ~50% cancellation fee if there's less than 2 weeks before the start date, they have decreased this down to 20% due to what is going on. I could have kept the tickets since Disney/Universal were extending them until the end of 2021, but due to an ongoing family illness I'm not sure if/when we will be able to go on this holiday once this craziness is over. Therefore, I've opted for the refund, which means only getting 80% of the value back. Which means I loose ~£500 over all the tickets. 

I don't think I am covered on my travel insurance to claim for this remaining ~£500. The policy wording specifically states that additional travel expenses/pre-paid excursions are not covered if the holiday is cancelled due to "advice of the Foreign and Commonwealth Office not to travel" and stipulates further that no cover is provided due to "fear of epidemic, pandemic, infection". It seems that I was only really covered due to unexpected illness.

I did however pay using my credit card. Is it possible to claim for this remaining 20% via Section 75? The place I bought the tickets from is processing my refund and will send me a cancellation invoice once the funds are returned, so I can use this as evidence. I'm just not sure if the credit card company has to claim the whole amount of if it can be a partial claim as I've already recovered most of the cost.

I would be grateful if someone could give me any advice or other alternatives. I understand it's not the biggest amount of money to loose compared to other things that are going on but I would still like to try to get it back.

    Personally I think it's doubtful as you used a 3rd party site, and got 80% back.
    But there is nothing stopping you from trying.
