    Good Morning Steven,

     

    Thank you for your recent email. I do know how distressing the cancellation of your wedding must be for you both.

     

    With regards to the below email, I would respectfully advise you that insurance policies, such as the one covering your agreement have specific terms, conditions and exclusions.  Under Section A Part 1 - Cancellation

     

    What You Are Covered For:

    We will pay up to the amount shown in the

    Summary for any irrecoverable expenses incurred

    by You in respect of Ceremonial Attire /

    Bridal Attire, flowers, photographs, caterers,

    transport, accommodation and the services from

    any other Wedding supplier booked but not used

    as a direct result of the unavoidable cancellation

    or curtailment of the Wedding or Wedding

    Reception as the result of:

    1. the booked venue for the Wedding or

    Wedding Reception being unable to

    hold Your Wedding due to an outbreak of

    infectious or contagious disease, damage to

    the venue, murder or suicide at the premises

    or closure of the venue by the relevant

    authority

     

    I must explain the policy terms and conditions relating to “the closure of the venue by the relevant authority”. 

    If there was an outbreak of an infectious or contagious disease at the venue (such as food poisoning, vomiting bug or coronavirus at that venue) which resulted in the closure of the venue by the relevant authority, then this would be covered.  However, in your individual claim circumstances, the venue was not closed due to an outbreak of an infectious or contagious disease at that venue.  It was the regulations imposed by the government on mass gatherings, social distancing and measures requiring people to stay at home, except for very limited purposes, which led to the closure of the venue.

     

    Unfortunately, I am unable to agree that you would have a valid claim for the cancellation of your wedding  due to Coronavirus pandemic. 

     

    I do hope that the email above clarifies our position and helps you to make decisions with respect to rearranging your wedding to a date in the future.

    It's very clear the relevant authority is the Spanish Government,  it is also very clear the reason for the venue was closed is because of COVID-19 (they have even admitted that you are covered for that)
    This I feel is important
    "Your Wedding due to an outbreak of infectious or contagious disease"

    Nowhere does it state that it is solely limited to just your venue,where as "damage to the venue" does mention the venue

    In the rejection letter it states
    "If there was an outbreak of an infectious or contagious disease at the venue"

    So the reason for rejection is wrong  as your policy doesn't state it has to be at the venue, just  cancelled because of a virus (which it was.

    I would sent the reply marked COMPLAINT as if you do that they have 8 weeks to reassess their decision
    I would also point out,if you still reject the claim, you will be going to the Ombudsman who will make the final decision.

    Thanks so much for your advice on this I would never have even thought of going back to the insurance company. Hopefully we may have some hope of getting our money back
