Onthebeach refusing refund even though they cancelled

Hi all,
I posted something about a month or so ago in relation to this but I’ve had confirmation. Basics of the story, we were due to fly to Malta from Leeds Bradford on the 14th of March. OTB rang me to cancel the holiday the day before (13th). After a lot of back and forth, I received the accommodation and transfer but not flights as I’m sure many people are also in this boat. However, this is the kicker, OTB are outright REFUSING to refund the outbound flight as it was a live flight and went ahead. I’m constantly questioning them, how could I possibly have gone on the flight when YOU cancelled my holiday the day before? They are just ignoring it and saying that it’s unfortunate but they can’t refund me for it.

I’m completely flabbergasted and will never book with them after this fiasco but I’m just wondering; from a legal perspective do they have a leg to stand on? Surely if they cancelled my holiday I should be entitled to a full refund regardless of whether or not a plane flew? There’s no way I could have been on the flight!
Any advice or help is appreciated!

From what I have learnt is you may not have actually booked a package holiday with On The beach? This has been discussed quite a few times lately and it is a technical point which I am still trying to get my head round. But, from what I understand On The Beach as well as many others act as third party agents to put a holiday together and match up planes with hotels, saving the customer from doing it. They don't offer a package holiday as such. Did your invoice itemise plane and hotel separately? It could well be that Ryanair have not refunded your portion of the outbound flight to On The Beach because the plane delivered? Very very unfair and lots of people caught up in this situation. I have faith it will be resolved eventually but when? 1,000,000 dollar question!0

How was payment made, was it one transaction to OTB or broken down into part transactions, or a transaction to another party (eg Ryanair)?Harley_woolf said:Hi all,
