When holiday is not as expected

Hi. We have a holiday to Disney Florida In August with TUI, 2 weeks at the resort. I understand the options, losing deposit etc but I was wondering if our holiday goes ahead ie flights are on and Disney say they are 'open' but it is a soft opening as in Shanghai - not all parks/rides open, restricted dining etc, would we be expected to go? Could we get our money back? As the holuday would most definitely not be what we asked for at booking. Just wondering your thoughts.

They normally have in their T&Cs something like " not all attractions might be open" so it could come down to how many are open.
I have no doubt that the legal beagles at Disney will look at.

If the restrictions were as significant as it appears they may be, then you may well end up having a valid argument that the contract should be voided. For now it is really a case of wait and see.If you do not proceed, do not assume that your deposit would be forfeited, regardless of what the terms and conditions say.Do you have a balance to pay, and when is that due?There is also a dedicated TUI refund thread which you may find useful

My thoughts are yes you would be expected to go and no you wouldn't get your money back if you cancelled. Having said that I don't think you should have to accept a holiday from TUI that is not as they describe in the brochure. I know people aren't getting a lot of joy out of emails and phone calls right now so I would wait until nearer the time to see how the situation is then (personally I don't think restrictions will be lifted enough in US by then to admit plane loads of visitors) But, should it go ahead and you find out prior to leaving that most of the park, restaurants etc are closed then surely this is a breach of the holiday initially sold to you and TUI would be obliged to refund or rebook you? In the same way, if you had arrived at your destination and the hotel was not as described, badly maintained, broken beds, empty pool, no entertainment etc. you would put in a claim for compensation. Just my thoughts though am afraid. I will leave the experts to advise further.

Might be a better experience. No long queues for 90 second experiences. No price gouging for overpriced catering. All round a more pleasant experience in a far quieter park.Safclass1 said:As the holuday would most definitely not be what we asked for at booking.0
