3+ months late rent

    Whoops, guess I explained that rather poorly.
    I'll start again.

    We own a house in Swindon which we purchased back in 2016.
    A letting agent found someone to let out the house to. The house is let out via a company lease not the regular assured shorthold tenancy.

    The company is a carpentry business. 
    Interestingly enough, the company (carpentry guys) don't have any sort of online presence. I'm sure it would be very difficult to get much business without any sort of online presence these days.
    This has made me think that perhaps the carpentry company is not genuine.

    So the main issue, which I'll word(hopefully) better is as follows.
    The carpentry company have not been paying since the start of the year. Despite much attempt from the letting agent to get the carpentry company to pay the rent arrears, nothing has happened. 
    The carpentry company often would pay the rent one month late. Not really relevant but just thought it would be good to add.

    As we rent a house in Bath, we are starting to feel the financial pinch. Because of this we plan to move to Swindon and live in the house (where the carpentry company is).

    We have given a notice to quit to them as we can no longer afford this.  
    After they leave, how can we get back the rental arrears.


    Hopefully this makes more sense 


    I hear the drugs trade has been quite disrupted lately....only kidding...kind of........
    County lines is still fully functioning.  With vehicle movements easier to spot.  Dealers have resorted to using kids
    masquerading as Deliveroo.........
    I can order drugs and a pizza? Sign me up!

    For three months rent? No way IMO.
    Okay, that seems fair.
    I think by the time they will probably leave it will be towards 5 months unpaid rent so maybe under £5000.
    It's quite alot but if a lawyer will cost even more there won't be any point trying
    Ok i'm going ask once more - What is the name on the agreement???

    I rather dm you if possible, because I don't want to give the company a bad rep
    I don't think he wants the actual name, just to know if it's the occupant, the agent, the company,  or....?

    OP, if you are certain you have a commercial letting contract, have you looked at the link given (upthread) about ending these contracts?

    I'm not too sure if a commercial let and company let is the same so I don't know if it applies. But I have already started the eviction process by issuing a notice to quit

    Is this company listed at Companies House? If so, are they still trading?  Are you sure they are a limited company and not a sole trader? That should take you about 2 minutes to check.
    If they are no longer trading as a company, then there are no assets to pursue and you will not get your rent back.
    My take on this is that your property was probably being sublet as an unregistered HMO to a collection of Eastern European labourers, who could be working legally or illegally. Work has dried up under Covid-19 and most of them have returned home...so no rent coming in.
    There may or may not actually be any carpentry company. 
    It would be interesting to see what references your LA took from this company!

    No free lunch, and no free laptop ;)

    Yeah I think your right about the labourers probably no real company there.
    On the companies house it calls the company a private limited company. I'm not too sure how to tell if they are trading. Interestingly enough the name on the companies house doesn't add up with the name the letting agent calls the carpentry man.

     People will be saving money on these things, surely that is to be celebrated, no? I agree it doesn`t help the OP much though, they need to be more aware and involved in picking the next tenant IMO.

    Have they submitted recent accounts? Application to strike off? Share capital? It's all on the CH site.
    Given that potentially numerous breaches are being committed here, both you and your LA seem to be taking a very relaxed view of this. It's you that could be liable, not the agent. The fine for an unlicensed HMO is £20K, and that's just one offence.
