Going back to work on 80% pay

I had a phone call end of last week to advise we are going back to work on 80% pay, I have been chosen as one of these key workers, not all staff are going back in they are still furloughed earning the same sitting at home, once things get going and we start making profits again our money will go back up to 100%.

I have mixed feelings about this, just seems really unfair?

They cannot use the govt furlough scheme to pay you whilst working. (Unless this is not what you are saying)

it is unfair but nothing about this virus is fair. It’s a contractual dispute.

The company are paying us 80% unless they are committing fraud but how would I know that?, really rubbish as I suppose they are thinking if they can cut our money by 20% and we will still turn up they can keep doing it?

The more I think about it the more angry I’m getting.

Getting angry won't help anything, least of all your blood pressure.  If you aren't willing to turn up for 80% of pay, see if you can negotiate your usual rate - but you may find the answer is a P45. Is that a risk you're prepared to take?

try and arrange to work less hours, obviously if they can't afford to you full pay then they have less work for you to do.

Your employer can't vary your salary without your consent. However, if you refuse, you would have to claim for the excess, and the employer may then look at dismissing you or making you redundant. You can be dismissed simply by being given notice within the first 2 years of employment.

The employer can't use the furlough scheme to pay you, if you are working. However if the employer is paying the 80% rather than the government there's no issue there.

This is the only useful answer so far. If you have more than 2 years under your belt then just tell them you reject the pay cut but are willing to continue on your current terms or, if you feel like it, reduce your hours by 20%.

If you haven't been there two years then you could either risk it or just ask them to reduce your hours, or maybe make up the back pay when things get back to normal.

Thanks for the replies, been there 1 year so going to have to lump it I guess, better than being laid off then I would be in a mess, can’t imagine many companies are setting on at the moment.
