Pip Tribunal query

I am writing regarding my son
Hi, I recently had my tribunal without me attending and the tribunal agreed with me so I contacted them to tell them I agreed with their decision and was waiting for dip to do the same. This was over a month ago, is it normal not to receive any money or information from the dwp within the month?
I'm getting worried

    Under normal circumstances it can take 8 weeks sometimes longer to receive backdated money after a Tribunal decision. These are not normal times so it could be longer. DWP will eventually contact you asking for bank details and whether you've been in hospital recently, once that's done it shouldn't be too much longer. All you can do is wait.

  • When I went through my tribunal and won, I waited a good while for the DWP to get in touch.  Eventually I rang them and they denied receiving notification from the tribunal.  It then took another while to sort this and get my money.  I would ring them to at least confirm they have the tribunal's notification.

    Funnily enough, they have denied receiving mail from me on four seperate occasions too, one of them a MR.  Obviously this is completely true and not complete bull, as they wouldn't fib, would they :wink:

    Lol. I rang them today and they have received it and asked me if I've been in hospital or been abroad in the past 6 months. Hopefully shouldn't take too much longer

    They also said they haven’t decided yet which is strange because the tribunal made the decision. They are supposed to appeal against it within 28 days and it has gone past that. Still worried now 😕
  • If they have 28 days to appeal the tribunal decision and this has expired then I would think that they have no choice but to accept the decision.  Even during the current situation with Covid 19 28 days is a long time for them to not appeal if they wanted to.

    I would suggest maybe ring again.  I wouldn't be surprised if you were told something entirely different and that you are being paid very soon.

    Thank you. I got told by the guy that helps me that they just accept it normally, but in this current climate it's pretty much guaranteed they will accept it. Hopefully it will come soon. I just worry a lot lol, it's been a long long process :)
  • I must admit that I haven't heard of them not accepting a tribunal decision.  Sending someone to argue their case at the tribunal, yes, but not afterwards.

    I know what you mean about it being a long long process.  I'm sure it's designed that way  :s.  Nearly there now...

    That's not correct, sorry. They have 1 month from the date of the decision to request the statement of reasons (SOR), they don't have 1 month to appeal. Once the SOR has been sent by HMCTS then they have 1 month to appeal BUT they can only appeal on error of law. They sometimes request the SOR but rarely appeal it.

    Unfortunately, all you can do is wait. It can take about 8 weeks under normal circumstances to receive backdated money but as i advised, these are not normal circumstances.
