No furlough

Hi my employer has paid me furlough money before the portal was opened for applying but they are being refused furlough as they don't have PAYE payroll. So I'm now not left with no wage,what are my rights and will I now have to apply for universal credit until lock down is lifted if I can't find other work in the meantime? Thanks

    If they don't have any PAYE staff then technically they are not an employer. You are presumably a self employed contractor and they are your client?

    How much were you earning? I believe if they have any employee earning £120 a week they HAVE to run a payroll through PAYE.

    But yes you will have to apply for UC.

    Not all "employers" need to have a PAYE scheme.  Not having a PAYE scheme (assuming for valid reasons) doesn't mean the staff aren't employees.

    If they don't have a PAYE scheme then they can still furlough their employees but they will not be able to claim anything from HMRC under the Coronavirus Job Retention Scheme.
