Auxillis TP denied liability

Does anyone have a happy ending with Auxillis and disputed liability? We ended up having a hire car for 5 weeks whilst auxillis spent an age on fixing our car. We were pushed into this AMC scenario by Admiral and we didn’t look into what the process was stupidly as we just trusted Admiral who didn’t outline the risks until AFTER the car was fixed and we realised what mess we might have got ourselves into. Having 2 kids under 3 in a time of national crisis (keyworker jobs too) means we just didn’t have time to research everything. The TP driver admitted liability at the scene but seemingly has gone back on that now. Has anyone had liability disputed and had a happy ending? I’m petrified that they’ll conjur up a way to accuse us of misleading them in order to
chase us for payment,  which we absolutely haven’t, but all these threads make them sound no better than loan sharks so I don’t feel like I particularly trust them now. FYI we have the credit protection policy in place, so unless they decide to accuse us of fraud, we shouldn’t have to pay, but I can’t help but worry that as it’s our word against the other TP, they’ll attempt to say we’re lying solely because all they care about is payment.

    It's a credit hire vehicle, which means no money is paid in advance like with a hire car, due to this their costs are more. 

    The third party is entitled to change his stance on liability, in insurance T&C's it always says not to admit liability at the scene and leave it to the insurance company.

    Depending on your version of events and damage to your car PLUS the third party's version of events and the damage to his car it could go 100%, 80/20, 70/30, 60/40, 50/50 for you or for him.

    If liability remains disputed and you have a strong enough case, court proceedings could be issued and eventually you attend court*, tell the judge what happened, as does the third party and s/he makes a decision.

    *depending on how much is claimed if small claims it's very informal and heard in the judges room, round a large table.
    Mortgage started 2020, aiming to clear 31/12/2029.

    I am having the same thing too...TP doesnt seem to accept the fault. The point is I am on my Tier 4 visa that is going to expire in Oct, unless I got my work visa, otherwise I dont know whether I can attend the court sessions. it is not logical to fly to the UK just for the court sessions LOL
  • Well these days you could probably attend court via Skype anyway.

    Auxillus said any delay of the payment (valuation of my car) caused by TP will be pushed back to Admiral and they said I didnt need to make a claim. ahhh...I dont know. it makes me so confused.
