car insurance claim

here goes
on 0ct 31 van hit my car from behind i was stataionary indication to turn right got out exchange details i had witness in my car and a independent witness who was driving passed got home rang my insurance to tell them and his details would not show up so got my legal assistance on it(i,m ringing up other driver never answers his phone when it is answer it one of his drivers

about 1 week later saw van locally got right details passed on to my legal assistance now getting on for end of november rang back up my legal team
and was told the other driver has not even reported it yet so they said they
will have to wait till his insurance notiftys him and he gets back to them
i am worried now that he can just denied the accident my car is likely to be a write off i have only third party fire and theft can,t afford anything(as i was thinking of going bankrupty before this happen

what can i do to improve my chances of getting this claim from his insurance
police were there but only the aftermath as they pulled up as he pulled away
and they were on interested if any one was hurt gone down police station not intersted at all

    His insurers cannot act on your claim until he decides to report it to them. However, they should be pressing him to report it but to be honest, it is probably a low priority for them.

    The only thing that really gets them motivated at this stage is rising costs. By this I mean storage charges or hire car costs. If these are being incurred and are rising, then it is in their interests to get the matter dealt with as quickly as possible to reduce the size of the claim. They would go back to him and say "report this claim now, over the phone, otherwise we charge you for additional costs incurred because of your delay".

    The other thing that gets matters moving is injury. Now I am not suggesting that anybody lie here but was anybody in your car injured as a result of the collision?

    so far his insurance has tried to contact him but they are having trouble as well(they have tried ringing (mobile as well)him & writing to him giving 7 days to reply but still nothing what can i do
