Hi can anyone me with a couple of questions on this please.
Background - various flights, transport and activities package cancelled by travel agent just under half way through a 4-month trip in SE Asia. Company advised passenger to return to UK but after several attempts was unable to do reschedule passengers return. Trip cost in total was £4500, approx £2500 of services were used. After numerous attempt to change flights, and extra charges being applied for these, the travel company seemed unable to get the passenger back to the UK so we funded this ourselves at an additional cost of around £600 - 1 domestic plus 1 international flight.
Company has offered vouchers and extended use by date on them to Dec 2021, which is not practical or wanted.
Refund requested and vouchers offered as per updated refunds policy. No formal rejection of refund request has been given
Now being escalated within company and they have been informed unless this is resolved a small claim a.k.a money claim will be made to recover the money owed.
Questions
1) Should the small claim include just the costs of goods/services not provided or include the additional costs incurred to return home (return tickets were part of the package)
2) Value of all flights sold was £2600 but this was never broken down, whats a reasonable approach to value the unused tickets
3) At what point should interest be calculated from and what rates should be used -considering recent BoE rate change to 0.1
4) If 1 ) includes other costs Are there any other reasonable costs that could be included in addition to direct costs of the small claim
5) If vouchers have been put "into an account" already and are available to use - do these need to be formally rejected / told not wanted - its unlikely they will be able to be used anyway but will it affect the claim
6) Once the request for refund is rejected in writing by the supplier, what else should be done before proceeding with the claim

Small claims doesn't normally allow for expenses. Travel insurance should cover
Small claims is going to take an awful long time due to backlog .

I'd abandon the thought of interest and go for a straight claim.
Valuing the flights is a difficult one. I'm in the same place, though much simpler in that I got my outbound flight and not my return, so if it comes to small claims I'll go for 50%. Try a percentage - don't take advantage but don't value it too cheaply. Flights in Asia can be very cheap. It will then be up to the company to respond to the claim and argue it down in their defence.0 -
If you paid via credit card you could file a S75 claim and get refunds from the unused flights and the extra cost of buying more flights.
