Refund instead of credit

Hi,
I was hoping someone may be able to think up a magic loophole for me.  To be as brief as possible, I booked a day event in Marbella for a large stag party through a 3rd party company.  The venue took the money immediately from said 3rd party and are now refusing a refund, with only the offer of a credit which would expire around a year after the scheduled date.  They have threatened to removed the offer of credit If i try to claim through charge back or my travel insurance.  My insurance said they can't make a claim as the venue have offered a credit and my bank have said that they can't claim chargeback if the terms and conditions are met which unfortunately it appears they are.  Please can anyone help?

    Have a read around a selection of the thousands of similar queries on here.  There is no magic loophole but there are strategies, some of which have proved to occasionally effective, but many will take a long time to come to fruition.

    As a general comment on your specific situation, you should be dealing with the company with which you have a contract - it sounds like it's the "3rd party company" you mention.  You have no rights with the venue directly.

    Was it a debit card or credit card for payment?

  • It was a debit card payment unfortunately with my Santander 123 account

    What date was it for?

    It was booked for the 9th May and paid for early March

    Sound to me that your contract is with the 3rd party, so would be them you chase it up with.
    The event clearly will have to be cancelled as Spain is still in lockdown and still will be in a few weeks.

  • No I haven’t cancelled it. Love Banus (3rd party) informed me that the event wouldn’t go ahead and the venues stance on it. The 3rd party have a clause in there terms and conditions which seems to prevent me from claiming chargeback off them.

    If a company has a clause that stated something like "you can't claim a chargeback"
    This would be classed as unfair,  so it would be declared  null and void, as no company can stop you.

  • No the clause was for things out of their control

    Normally a company has a clause that stops compensation with the "Act of God"   clause for things out of their control
    It can not be used to stop a refund.
    I they are still offering a credit voucher, I see a couple of options,  take the voucher  or file a Chargeback.
