Mortgage Payment holiday Fraud

I'm currently going through a divorce and have a joint mortgage with my husband.  He has applied for a 3 month mortgage holiday "due to the impact of coronavirus" without consulting me.  The Judge at previous hearings has already said that I am most likely going to retain the property providing I can meet the mortgage payments.  In view of this I will be solely responsible for the extra payments due as a result of this mortgage holiday that I did not agree to.  It is my understanding that the scheme is available to people specifically FINANCIALLY impacted but he is a serving senior military officer and has self certified that he is impacted even though his income remains the same.  Surely this is fraudulent??

    The mortgage company will have had a little tick box or suchlike on the application which asks something along the lines of "if this is a joint account, are all parties happy to apply for a holiday". If your husband has ticked this falsely, then you should contact the mortgage company directly and tell them the situation.

    I doubt they will take into account what a judge said about future events, but the fact that you did not agree will have bearing. Talk to them.

  • I think my main concern is that someone who continues to earn 100% of his pay is not entitled to a mortgage holiday at all.  it is personally profiting from a national crisis and from a scheme set up to help those in genuine need.....

    Unfortunately it is for the mortgage company to decide what critera they use for granting payment holidays and due to the huge volume of requests I think they are all using the same; if you ask, you get (provided you are not in arrears).

    If you go ahead and make the payments anyway then it should cancel out the holiday and any extra interest at the end, obviously tell them you are going to do this though.

     He is probably one of the only people in the country who stands to profit from the mortgage holiday.  Anyone who takes the holiday and actually has to pay it back will ultimately be worse off - only resulting in increased profits for the banks.  This is because the missed payments continue to accrue interest until such point as they are paid off.  
    No-one should take a payment holiday if they don't actually need it for that reason.
