We have a hotel booking in Spain that was done through Booking.com. It's for next week.
The booking was non refundable and we are fine with that situation if we were to later cancel a booking on that basis.
However, the hotel is closed and cannot honour the booking. They have offered a credit which we can use by the end of the year.
Booking.com claim we cannot have a refund as it was non refundable. However, in the current situation, the hotel cannot provide the service we have paid for so surely that's not legally correct?
We paid by credit card and also have an annual travel insurance albeit there is an excess of £75 per person.
Can anyone advise on what are rights are with booking.com and how we should go about dealing with this?

You're entitled to a refund. Have a look around the forum and see how much difficulty you might have in getting it, though.1

I was in the same situation but did eventually persuade the hotel to issue a refund on the basis they wern't able to provide the service I had paid for. Non refundable doesn't just mean "take the money and provide no service" and I suspect the risk of a credit card charge back changed their stance. If you still get nowhere with the hotel though I advise contacting your card company.
