Furlough period 3 weeks

I have been on Furlough since 23rd March . I am on the second lot of furlough , we had a letter to say this was till 4th May but they worded it so it could be subject to change.  I had a call last week stating they wanted me to return on Tues this week.  If  I didnt do as requested then I would have to take this week as Holiday or unpaid . Can they do this as  I was half way through the second furlough period of 3 weeks ?   Also they want me to return to work nights  from 10pm til 6am  .  it is in retail non essential  greeting cards . Given no PPE .

Why would you have to take the week as holiday or unpaid because they want you to come back to work?  Remember that what you are entitled to be paid is per your contract of employment, as amended when you agreed to be furloughed. I would guess they have reduced your pay to 80%? This rate will apply whether or not you are furloughed, if that is the case. Whether or not the employer can claim CJRS should be a matter for them, unless your contract was amended to say they could recover any failed CJRS claim from your wages.

As a separate matter, employers can ask employees to take holiday while furloughed, provided the proper procedures regarding notice are followed.

Furlough is not blocks of 3 weeks but a minimum of 3 weeks.  Plus, as Jeremy points out, the employer can bring you back whenever they want (they just may not be able to apply for the furlough grant, but that is their problem, not yours).
