FTB - storing vendors furniture until lockdown over

    I expect her biggest problem is disposing not collecting. The tips are closed and so are charitable stores like the British Heart Foundation.

    How full would the garage be with this stuff?
    Would your solicitor hold onto a retainer from the purchase to cover the costs of disposal should the vendor fail to adhere to any agreement you came to? This way you havw the money to dispose yourself without being out of pocket.

    Just a thought but are we sure that the mortgage co (assuming the op needs a mortgage) would see this as 'vacant possession'?
    How would they know?

    If the solicitor knows then they will (probably must) inform the mortgage company.

    If the solicitor knows then they will (probably must) inform the mortgage company.
    Yes, in practice it will be the solicitor's decision, not something which is likely to go to the lender. In practice I wouldn't expect the lender would give two hoots about some junk being in the garage, no matter who it belongs to. What they want to avoid is an actual human resident cluttering up the premises when they're trying to repossess.

    Many waste removal/house clearance firms are operational at the moment, so the vendor should pay to have it all removed. She'd be mad to delay her sale for this this, especially during the current climate.

    Given you will have a van already, could you not just put the stuff in the van and drop it off at the vendors?

    Thanks for the responses folks. I requested a list of the exact items and it turns out the the 2 double beds, 2 sofas and a few other items were purchased by the tenants, so if we stack the vendor's remaining furniture in the corner we'll be able to squeeze our things in there too, there won't be any space but at least we'll be in before lockdown,  hopefully.

    There's been a development. EA has emailed saying they misinterpreted what the vendor was saying, the vendor doesn't want to pay for the furniture to be removed after lockdown, she's said if we want to move in during lockdown we'll have to take the property complete with furniture and arrange disposal ourselves, otherwise we'll have to wait until after lockdown for her to dispose of the furniture. But, the estate agents, being the Knights in shining armour that they are, have offered to give us the details of a contracting company they use.

    This is a complete turnaround and I suspect the 'misinterpretation' of the EA is some sort of silly game they're playing on order to pass disposal costs on to us, they were also the letting agents for the previous tenants.

    I replied saying we'll wait until after lockdown. If the vendor wants to hold up the sale and have an empty house for weeks on end just because she doesn't want to pay to empty the property then it's her decision.



  • If you haven't exchanged and you are under no timescales in your existing rental I would say you've done the right thing.
    Power in these situations usually resides in who needs the deal least.
