Amazon Refund and Item Return

The item I purchased from a seller on Amazon was not as described and totally different none original packaging. I contacted the buyer asking for an uplift and refund - the return page asked me for the issues which I duly put on the form - the seller contacted me after 2 days and asked what was wrong with the item, again I informed the seller of the issue - he emailed me for a 2nd time asking the same question saying it was in fact the correct item, I informed him again that this issue has already been made available in the return request and in the email I had replied to. I did not hear anything for a couple of days so I put in a dispute with Amazons complaint service stating that the seller had not agreed the uplift and refund - they investigated and upheld my complaint and I was paid a full refund by Amazon.
Today I recieved an email to say the refund had been made - it also said that if I wish to return the item I should contact the seller - as I have already contacted the seller and they have not arranged to uplift the item how long do I need to hold on to it before I dispose of it? I do know I have a duty of care to hold on to it for a set amount of time but I am not sure how long that is.

You're now an involuntary baillee. As per above the Limitations Act applies so the seller has 6 years within which to claim back the goods (or their value). You can send (in writing) 2 letters to the seller advising them that they must uplift the goods (wait 14 days after each letter) ... if they don't respond then you can dispose of the goods for fair market value and then retain that value (less reasonable selling expenses) for the 6 year period.3

I would love to sent it back or write a letter but I have no address - I have told Amazon that the seller has not responded but have had no reply from them - I have also had no response from the seller (who I have notified 3 times in total to uplift the item) when I have messaged them through Amazon.

It is OHP sheets - I will give it a try thank you.So had a look and the seller is from China - I didn't realise that when I purchased the item but it arrived within 3 days. I have checked out the return and refund status and it says a refund has been issued - I have not been asked to return the item 1st. I cannot find anything on the sellers page about returning the item even under the heading for returning. All very odd - maybe that is why I was given a refund by Amazon and not asked to return the item.0

It might be its not worth paying for a return if the postage will be more expensive than the product. I expect they have a UK warehouse somewhere for common products but the company is based in China - very common. If they don't contact you, just keep the product for a few months then dispose of if you need - it's very, very unlikely they will chase you.2

Do bear in mind that there may be no staff to deal with any return currently. The fact that they are not replying to e-mails would seem to bear out that hypothesis. If Amazon have refunded under their A-Z guarantee, they do generally tell you if they want it back or not.Regardless, storing it safely for a period should not be too much of an imposition and you are not at all out-of-pocket...1
