Can I view deceased bank statements

I am the executor of the will and have informed the bank Nationwide that they have passed away and provided the death certificate. Can I request copies of bank statements from the deceased account for the last 6 months? we suspect some financial abuse by a 'friend' and have a signed copy of money owed which was completed by bank transfer but to pursue the person to try and reclaim the money would require evidence this has been paid. I also want to check there is not anything further as over £50,000 appears to have vanished in 6 months. Also has anyone pursued a personal debt after death and have any advice?

    Yes you should be able to get statements. You'll need to show ID.

    Speak to the bereavement team, they will be able to provide statements for the last 6 years if required.

    How much is the documented loan for? If no more than £10,000 then you could pursue it through the small claims system if they can’t or won’t pay it back. If it is more then it become more costly to pursue.

    The problem with any other sums that has gone to them is proving that it was a loan rather than a gift.

    Thats the limit to use MCOL (the online service) - not which track it will be allocated to.

    Otherwise, the small claims track will be the normal track for –
    • any claim which has a financial value of not more than £10,000 subject to the special provisions about claims for personal injuries and housing disrepair claims;

  • I only have about £4500 in bank transfer loaned to this person, text messages and emails suggest there was lots more in cash which we wont be able to prove. I need to check the bank statements to see how much has been transferred. Very close to her death she got this friend round and got her to sign paperwork saying the amount was owed but it was not witnessed by anyone. I will be seeking to get this back through small claims if I can. I've learnt her son is in prison for fraud and it was only 2 days after my relatives pension lump sum was paid she got her to lend her money knowing she was terminally ill and I'm pretty sure she never had any intention of repaying it. There is no estate as with debts it zeros out but this isnt about the money it's about her not keeping it as she took advantage of someone very ill on strong drugs and gave her alcohol when she asked for these loans when on all expense paid holidays as my relatives carer.
