will my past commission earned be taken into account when calculating my 80% furlough pay?

Hi - I have been furloughed since 19.4.20 I am a new homes sales advisor earning a salary plus commission- my question is: will my past commission earned be taken into account when calculating my 80% furlough pay?
the government website states that compulsory commission will be taken into account, however discretionary commission won't be taken into account- I'm not sure if my commission comes under 'compulsory' or 'discretionary ' although it doesn't state in my original contract that my commission is descretionary - can anyone please advise as my employer states it won't be taken into account.
also will past over time be also taken into account??

What is your employer saying based on your employer's understanding of the scheme they operate?

Essentially it is up to the employer to correctly calculate a) your pay and b) the amount they can reclaim. They can be two different amounts as some valued sales people are kept on 100% even though their employers can only recover some of this.

Can you be a bit clearer on that you think the issue is?
    • All land is owned. If you are not on yours, you are on someone else's
    • When on someone else's be it a road, a pavement, a right of way or a property there are rules. Don't assume there are none.
    • "Free parking" doesn't mean free of rules. Check the rules and if you don't like them, go elsewhere
    • All land is owned. If you are not on yours, you are on someone else's and their rules apply.

If your contract of employment sets out the basis on which you will receive commission, and if you meet the conditions your employer has to pay you that commission, the consensus of opinion is that it should be included in the calculation of reference salary for CJRS.
  • If you’re commission is varied and comes from selling/renting properties then I’m sure that they will say you are not entitled to it. Your company however can pay this if they want to
  • If it is contractual commission then yes. I believe you either get 80% of what you earned the same month last year, or if you’ve worked there less than a year it’s an average. I work in sales and my commission has been included.

Hi , This is how I have read and understood the government guidelines regarding commission, however I'm still not getting it based on my commission or overtime, it has just been based on my annual salary. I have emailed my employer numerous times and just given up on it now.
