Am i entitled to a Eurocamp refund?

Hi all,

I've had my Eurocamp holiday cancelled due to the coronavirus. Eurocamp are point blank refusing to give me a cash refund and only offering me vouchers. Ive read on here before that i don't have to accept vouchers and i'm entitled to my money back. Can someone please point me in the right direction? I've also tried to claim my money back through my travel insurance provider Legal & General but buried in their terms in conditions they state they don't pay out for cancelation of holiday due to a pandemic. Any help would be greatly appreciated.

    If we cancel your booking:
    If your holiday is cancelled you can either have a refund of all monies paid or accept an alternative holiday of comparable standard from us if we offer one (we will refund any price difference if the alternative is of a lower value).

    You can have a full refund without any deductions
    They will offre people vouchers and claim it's a "full refund"   but it's not if you reject it.

  • Further to the email i sent to Eurocamp explaining about their own T&C about me receiving a refund they have since replied stating: as advised we are not issuing refunds, i understand you may be disappointed by that response but we will not deter from the policy we have in place.

    Where do i go from here regarding my refund as they are point blank saying no even though their website states i will receive a refund?

    Legal action, which will take many months and which may not be successful because it seems the rules are about to shift.

    Rumour has it that finally the UK Parliament will rule on changes to the Package Travel Regulations tomorrow or 22 April.  This will potentially allow for refunds to be offered in the form of credit and will put the UK in line with amendments made by the Germans, Dutch and French.  ABTA have been trying to make sure that there is consumer protection for such credit notes that its members may issue.  For now with Eurocamp I suspect a credit note will be the best offer you will get.   Legal action will change nothing as not only is a future small claim court action months and months off - by the time it reaches court the legislation will likely have changed in favour of these credit notes.

    I used my debit card to pay for the holiday so no protection as if i used a credit card i assume?

    Even credit cards are not giving refunds if a credit note is being offered.

    They might say that but legally it's not correct
    You are entitled you your money back,  a voucher is not getting you money back.

    If it was legal  companies would have in their T&CS  that any refund due to cancellation will be in vouchers This simply isn't allowed legal, the consumer has far more protection than that.

    The Chargeback  on a debit card isn't a legal right, where a Section 75 with a credit card is.
    You need to call  your debit card company and ask for a Chargeback on this transaction explaining that they have cancelled and you are due a full cash refund that they are withholding. If you get a refund it's up to the debit card company.
    If the debit card company doesn't pay up then you need to keep on at Eurocamp,  if they still don't give you a cash refund then you can take the voucher  or take them to court.
