CCJ not removed against my name

UPDATE from courts based on my chasers to them today - Following receipt of Defence, the judgment has now been marked as set aside on judgment register.
Does anyone know how long that takes to update trust online (https://www.trustonline.org.uk/) or is it all just one record?0 -
Not sure of timescales, try emailing a copy of the paperwork to info@trustonline.org.uk - they won't remove it based on that but will talk to the relevant court.
I'd imagine it should be quick (they slap the CCJs on quickly enough!), but you might well get an answer like 28 days or something.
For the mortgage application, if queried, I'd send a copy of the initial set aside (providing you file defence etc.) and also the final update you got (confirming it'll be done).
Obviously, depending on the circumstances, the whole issue might impact whether the lender would actually lend to you or not (e.g. if they know you may get a CCJ issued shortly (if your defence isn't good enough) they may not lend). But if you have an application in already, then presumably they're aware of the situation and happy to proceed once you provide proof?
If you don't have an application in, it's probably worth discussing it prior to submission. Although your record will look clear once it's set aside, if a CCJ does get added after submission (e.g. your defence fails) then that'll really knock you back (material application change) - unless the lender is one that will lend with a recent CCJ.
Of course if you're confident you won't get a CCJ, you could just not mention it at all (once it's cleared from your file), that's your choice - but it's a massive risk if you're with a lender that aren't adverse friendly and you don't win in court.0 -
CCJ's are removed when the courts update the relevant systems, and it's only done once a month. My own set aside took 3 weeks to be removed. As a point of interest, the data you look on within the various credit reference agencies are usually based on snapshot information at one particular time of month. Once the CCJ has been removed - you may find it still shows in your CRA reports for another month. Lenders however see an up to date file, and once it's gone it's gone, even if it's still showing in your CRA files.0
