Daylight Robbery

Without my knowledge Capital One credited my account with a Plevin PPI refund and then promptly withdrew it. Because my account had shown a credit payment my monthly direct debit which should have cleared the account was not taken. Because of that my account went into overdraft and I will now get a £12 penalty charge. Daylight robbery or what!

  • Not so. I spent more than half a hour on the phone to Capital One this morning and they say that any credit automatically affects the direct debit and I will be charged.

    If the direct debit wasn’t taken then now did you go into your overdraft?

    refunds do not normally count as a 'payment' on credit cards.
  • You are absolutely right, refunds/credits should not interfere with arranged Direct Debits but Capital One do take credit payments into account; normally that would not be a problem but they put money into my account without informing me then withdrew it and failed to complete the Direct debit causing all my spending in March to be carried over into April, hence my exceeding the card limit and the £12 penalty. I just wonder how many other Capital One customers have been ripped off like this.

    So was this a refund you were expecting? Have you made a PPI claim? What was the reason for putting it, and then taking it out? Was it your money, or an error?
  • I had made a PPI claim against Capital One via Gladstone Brookes and they sent me a cheque. For some reason Capital One also made several payments to me and then reversed them but without telling me. They then decided not to clear my account via a DD as was set up on the flawed basis that credit had gone into the account. If they do this to the many PPI claimants they have they will take a lot of £12's.

    It seems like part admin error and part you not paying attention to your credit limit. I can understand why they wouldn't refund the £12 but I don't think this will happen often as most people pay attention to their credit limits.

    If they made several payments to you, why didn't you contact them if you had been sent a cheque, or didn't it matter whilst in your favour.

    You need to raise an official complaint with Capital One. If you were on the phone to Capital One you were probably just talking to a normal call centre operative, and depending on your tone, they may have only given out the normal line.

    If you have a DD set for full balance then it is Capital One who send the request for the amount. So the problem in that case would be on their end. Though it does not seem to be the DD that is the problem, but because you had the PPI you assumed you had more left to spend and when it was withdrawn your spending put you over.

    Still, raise a complaint, and they will look into it.

    So yes - an administration error rather than daylight robbery. You received the money as a cheque - then received it as a transfer - they realised they'd double paid you, and took the transfer back - resulting in your unfortunate situation. A politely worded complaint will resolve the situation - it might take a little longer than usual due to the current worldwide circumstances - but I'm sure it will be resolved. It's certainly not daylight robbery though. As a learning point, you might want to keep a check on your credit card balances in your app - or online - once a month just to ensure all activity is correct. If you're not in the habit of checking it - who knows what else you'll be charged for? there may be illegal fraudulent transactions taking place - and that WOULD be daylight robbery.  For now - put your complaint in - and it'll eventually be sorted out.
