One Parking Solution/DCBL - parking on driveway


Apologies if this is a repeat of previous threads - I've read what I can in the newbies section, but the formatting on my computer makes a lot unreadable - and I can't work out how to view it properly, sorry!!
I got a PCN July last year, which I contested with OPS at the time, and got declined. I've now had a 'notice of debt recovery' from dcbl (it does say it is not subject to high court of bailiff action). I was staying at my mum's, where there are bays for parking. Her marked space is below her property in a garage essentially without a door (it's a first floor house, you walk through the front door and straight up the stairs, and there is ground floor parking beneath) there is a driveway in front of the space. She was parked in her bay and I was parked on the driveway in front of her bay and received a ticket. I'm not sure why when clearly her garage and driveway a bay is even required. There are many others all parking in the same way, and other houses with no bays and just driveways, again who park there. I don't see that this can possibly be right!!!! I've heard others have ignored notices in the past and no more has come of it. However, I'm clearly worried by these letters though, but have no real intention to pay - but worry over the possible consequences of this.
Can you please advise if I'm best to ignore DCBL or reply in some way? Is POPLA appeal too late now/worth trying? Or do I sit it out and hope no court action follows - but I still defend if it comes to that? It's now a £100 with £60 fee on top. I was parked on my mum's drive in my opinion and I have no intention to pay for that privilege!

What does your lease/AST say about parking? Does it mention the need to display a permit? If not then it may take primacy over the self serving TnC of the scammer, and interfere with your lawful right to “quiet enjoyment” of your property, possible an offence under The Landlord and Tenants Acts.
Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs and work, and in some cases, cancellation.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies

You could reply to dcbl and deny the alleged debt
You should email a SAR to the DPO at OPS to obtain all your data attaching redacted copies of 2 recent utility bills as proof of I D under the GDPR law (not passport or driving licence)
No chance of any appeals , especially not popla3 -

The latest Edge is supposed to be even better than Google Chrome , Firefox and opera can also be used3

Are you in Sussex? I help people in court in Worthing, Lewes and Brighton v OPS.
There will be a claim in the end but this is not it.
DCBL Collections have just sent out a batch during lockdown, of OPS crap demands. I've seen several and they have basiacally paper-bombed people in their own homes this month to frighten the weaker ones into paying.
Companies like this should be illegal and banned from government assistance.
Anyway I can help you in person at court if this is Sussex, so which residence is it (exactly, where?) and does Mum rent or own her house? The parking place you describe is a 'flying freehold' (a space under a house) albeit you were in front of it.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
