Group action Claims for Diesel Emission Scandal. Dodgy Law firm, need advice please.

There are a number of sponsored claims for the VW emissions scandal in order to potentially get money back from a diesel car because of the court ruling a while back. So a company has put an online checker to see if you have a claim, whereby you enter your name, address and car reg into their checker. However upon doing so you then receive emails stating that you are now in a CFA agreement, which can be charged at £500 an hour(!) and to cancel will incur charges. Im not the only one experiencing this underhand, nasty tactic by this company. The company is called Milberg and the SRA are governing bodies, one which could remove them from such practise I would hope.

My issue is that it states in their documents that they send you to email or print and send off a tare-away form to cancel, which you have to sign. It says you can do either. Ive emailed them, within maybe 1 hour of getting the email! You have to reply within 14 days according to the documents. My email states:

"To whom it may concern,
I do not wish to proceed with any legal action concerning VW Emissions and do not not wish to employ any or any part of your services. I also ask that you delete all information concerning me from your system(s), as is my right under Data Protection Law.  
Thank you for your time."

It has been over a week and i have had zero acknowledgement. I have met a fellow whom has had an immediate reply when he emailed, why have i not had this? I feel worried that they are going to claim that i never emailed them. I have also written a letter saying the same thing but I've not sent it as family told me i was being dramatic, yet the fellow i have just met dealing with the same issue has stated they are wanting costs from him.

I am tempted to also get in touch with the SRA governing body, the firm is acting unethically, not adhering to the principles set out by the SRA. I do however want to cover myself should the worst happen. What should i do? should i send the letter as well? would they charge for receipt of the letter? or i can call them?

    Do you have proof of this? I've seen a dyno run immediately before and after the fix of one Audi A5 2.0TDI, and the peak torque and BHP actually increased. There was evidence of a reduction of torque at the low end, but this isn't part of the advertised spec?

    Do you have evidence to the contrary?

    What was under clocked on your car?  

    The scandal was because VW cars  "in the USA"  detected they were being tested for their emissions which set in a routine that altered the emissions
    during the test

    The test in the UK is not the same which maybe why you think people are being judgemental and question your losses.  Your car is not cheating the
    UK MOT emissions test.  Our MOT does not measure the Nitrogen Oxides on diesel engines during the MOT.

    That is why you get the question of what are your losses.  I don't think anyone claiming has answered that as yet?

    Also worth mentioning the 'fix' was not compulsory. There was plenty of information out there stating that having it done could impact performance and fuel economy, yet people still went and had it done.

    It was compulsory! i received a letter stating that i had no choice but to take it and have it 'fixed' by law. Thanks for your help and your condescension guys, its appreciated!

    No, it wasn't, and no, it didn't.

    You may very well have read that into the wording, and they may well have intended you to do so - but they didn't state it, and they would have been wrong to do so. What the letters said was that the fix was required to resolve the issue. In other words, without the fix, the issue would remain.




    Remember - VAG did NOT cheat the European tests, and the cars did NOT breach European emission limits in their unmodified form. They cheated the US tests, which had different and far stricter limits in place.

    Thanks but m y issue is now with this company milberg, despite the claim being warranted or not, i need help figuring this out. If you want to put the boot in then go ahead, but i will have to just report those that are vulgar or deliberately being abhorrent.
