Contractual parking charge appeal rejection - G24


I wonder if anyone can help me. I appealed a contractual parking charge last week from parking company G24. The charge was for overstaying 3 hours free parking by 22 minutes.

Have you read the Newbies at the top of the index page? The fully explain timelines.
Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully, when life gets back to normal, it will become impossible for those scammers who are left to continue their vile trade, but until this is done you should still complain to your MP, citing the new legislation.

Did the scammers claim there was a NTD left on the car? This is called ghost ticketing. They put a NTD on the car, take a picture, then somehow it gets removed later by some unseen force.
Check your working out. The date of the alleged event is day zero, so day one is the day after. I use a calendar and count off the days until I get to the posting/issue date, then add two working days. That is the date that counts.
If they are not claiming a NTD was given then they are truly out of time, but it won't stop the scam machine from grinding on.
They have seven months to obtain keeper data from the DVLA and can use it to request driver details. They may say that they believe the keeper was the driver, but unless you blab, they have no way of knowing.
They have told you they are not relying on the PoFA, which they don't have to do, but they cannot hold the keeper liable in that instance, although it may take a judge to put an end to things.
What happened when you complained to the landowner?
Have you complained to your MP yet about this unregulated scam?
Other than that you are in ignore mode unless you get real court papers in the next six years. Keep all correspondence safe until then, and inform the scammer's DPO if you move during that period.

G24 just like all parking companies will be losing £millions at the moment throughout the UK. G24 will want to hang on to every £100 they can get. Further appeals are pointless.
When this progresses, they pass it to 100% pointless debt collectors who lie and to be ignored.
Then a dodgy legal gets involved and that is the start of the problem for G24 because the dodgy legals add on a fake figures which the courts are spanking them for abuse of process.
Given the virus problem, you are months away from anything happening, if it ever does.
Where did this happen, a supermarket etc etc

If so, they are right. They had six months to get the keeper's details from the DVLA, and they can take as long as they like to ask the keeper for the name and address of the driver.
Take great care to ensure you never divulge the driver's details.

Just reply thanking them for confirming the keeper can;t be held liable as they failed to meet POFA deadines, and as the driver wil not be named, they must stop harassing the keeper and have no cause of action in law against that person.
You'll know already from the NEWBIES thread that PPCs don't *have* to abide by the POFA deadlines but if they don't, then only the driver is potentially liable for the charge, not the keeper.
And you'll know already from the NEWBIES thread post #3 about 'POPLA and IAS', not to try IAS.
So, see you later, if G24 try a small claim, if you cannot get the Head office of the retailer (or the retail park managing agents of it's a multi-store site) to cancel the scam PCN.
We never need G24 threads...sorry but we really don't, and nor do you!
Just read other G24 threads. Everything is already answered a thousand times on this forum about G24. They are all the same except at the moment more PPCs are likely to miss POFA deadlines so it just makes it even more important that people don't blab who was driving by writing some weak appeal.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
