Hi
Quick one my Mrs was put on furlough leave for 3 weeks but has been asked to come back to work after 2weeks (starting tomorrow). She has now been told she will be paid 80% for the two weeks by her company but the company will not be able to apply for JRS.
This doesnt seem right in my eyes.....the company should either be paying 100% of the wages for the 2 weeks or letting her stay off for the third week and claiming??
Any advice will be welcome

Well that all depends, on what your wife agreed with her employer when she agreed to be furloughed or (if the contract specifically permits furloughing) what the terms of her employment contract state.
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride1 -
I think you should accept it. As she accepted the 80% anyway and they are paying the 80% so she is in no worse a position then she would have been if had the full 3 weeks off.1

I don't see anything wrong with it - she agrees to 80% during the period she is furloughed. The difference is the money will now come out of the employer's pocket and not the government.0

In my Dad’s industry most who are working are taking a pay cut, these are unprecedented times so maybe you should expect it.1

What are the alternatives and how secure is her job?
If she goes back to work she will not be eligible for JRS, but at least she keeps her job.
Personally I think if the employer offered to pay 80% of her wages for the two weeks she did not work at all, that is a generous offer.
I don`t see why they would pay 100% when she wasn`t working. Or, as you say, they should offer her to stay on furlough.

As you later say "Each individual scenario is different" so please post a copy of the agreement your mrs entered into i.e. the furlough notice she was given (redact personal info first)ggw0403 said:Hi

I'm feel sure it will explain everything , because she did presumably agree to it in the first place.

I doubt it would explain much the agreement. I would guess if they could or not would depend on the main contract. But it is not something I would bother fighting. Lose 20% to stay at home for 2 weeks would love that.0

I personally think if someone is working a normal day in whatever guise, they should be paid 100% wage. I do though wonder if all these attempts at 80% are trying to bring all people down to minimum wage level? Before these times I also thought it wasn’t on to pay someone less then min wage if the hourly rate took them below. : /1
