Hi all,

I'm tearing my hair out with Sports Direct and no idea what to do next!

The short version is that they sent me the wrong item, and are refusing to send me the correct item until I return the incorrect item - even though I've told them I'm in isolation for at least 12 weeks due to my wife's weakened immune system from her immunosuppressant meds. It took a lot of fighting just to get them to agree to pay for the return postage - even though it was 100% their mistake.

Essentially, they have my money and have not delivered the goods, and the only way I can get my money back, or the item I ordered, is to risk my wife's health and leave the house to go to the Post Office - which I'm not prepared to do as she is such high risk. 

I've never ordered from Sports Direct online before, and from what I've read online, I'm not surprised this has happened. It's the principle of it that's got me. I've kept all communication through Resolver so hoping it will allow me to escalate soon.

PS Is it acceptable to return their stupid giant mug ('free gift') when I eventually return this incorrect item? Honestly.

    Unfortunately they can require you to return the other item before they send you your new one/refund. Is there no one you can leave it on the doorstep for for them to take it for you?

    Sorry, but I can't see what Sports Direct have done wrong (other than sending the wrong item, of course).  It's perfectly reasonable for them to withhold a refund or the correct item until you return the first.

    They are a terrible retailer and I wouldn't touch them with a bargepole, but they're not being unreasonable here.

    Actually I'm not sure that's right ... where the seller is the one in breach of contract I think they can't unreasonably withhold the remedy (e.g. refund) on the basis of not receiving back the goods. I think the refund must be made within 14 days (or is it 30 days?) of being notified of the breach of contract. If the consumer then fails to return the goods then the seller has a claim against the consumer, which they'd need to pursue via legal means.

    However I'm not 100% on this ... unholyangel (Devil Woman ;)) may be along soon to throw in her twopence - she seems to have a good graps of these things. :)

    Fair enough, but I wouldn't put it past SD to pursue those legal means!

    Too true ... the FCB doesn't care who he upsets. :)
  • I wish I could ask someone to take it to the post office for me, but I don't even have a printer to sort out the returns label!

    I guess it's not so black and white because of the current situation. Had it been another retailer who gave a damn about their reputation, they probably would have apologised and sent the right item, and not bothered about asking for the wrong one to be returned. It's the lack of empathy or bothering to acknowledge the difficult situation I'm in that bothers me the most! It's not that I want special treatment, we physically are not able to leave the house. It's the copy and pasted replies and them not reading my emails or responding to my questions. It's maddening!

    Maybe it's me being a bit thick, but if you could go to the post office what would you do about the return label?
