See Tickets - Partial Refund

Options

I bought tickets through British Swimming's official and only vendor, See Tickets, for the Diving World Cup in London.  Had I been offered the option, I would have agreed tom carry over the tickets to next years event. Indeed that would have been my prefered option as I struggled to get a good seat.   However the event was cancelled and I was promised a refund.

I have received a refund for only the face value of the ticket and not the mandatory transaction fee.  See tickets state that their terms and conditions allow them to retain the fee in the event of a cancellation. I could understand this if I had cancelled the tickets or wished to change them.  Surely as the event has been cancelled and I have not received any goods or services, i should be able to get a full refund of the total cost paid.  To clarify, these were print at home tickets, so no postage costs had been incurred in sending them to me.

Do the terms allow them to retain the fee in the event that they cancel?  If they do, then those are the terms you agreed to.  You have received a service; the transaction, for which the fee has been charged.

Not saying it's right, but that is probably their argument and they're probably correct.

Not sure it is a fair contract term though

If the fee was quantified and was reasonable when you booked, they would argue it was fair.  What's the context here?  What's the transaction fee as a percentage of the overall ticket+fee cost?

How much in transaction fees have you lost out on? Sometimes you need to pick your battles and work out whether the reward is worth the effort. (Although I appreciate that you may be bored at this time and this may be a welcome distraction).

https://www.seetickets.com/content/terms-and-conditions ... their T&Cs confirm that they will retain the booking fee / transaction charge:
    21. If an event is rescheduled, changed or moved, the Promoter will usually give you the option of either retaining or exchanging your tickets for the new date/location. If an event is cancelled by the Promoter you will normally be offered a refund. Please note that the Booking Fee and any Transaction Fees are not refundable in these circumstances. If you opted for Ticket Refund Protection this is also a non-refundable fee.

I am a carer and saved very hard to be able to afford to go.  I cannot afford to lose out money for nothing.

Also, it's like buying something for a price plus P&P and then the seller deciding to cancel the order without selling it but keeping the P&P costs.
I would argue it is an unfair contract term.

That's why two of us have asked you to quantify your loss.  If you want to recover it, the options depend on the value.

Sadly, my total loss is what most would consider to be little as it is just over £25, so nothing legally worth doing anything about.  For me though this represents over a third of my weeks Carer's allowance.

And the total cost of tickets plus fees?  That may help with challenging the reasonableness of the transaction fee.
