LCWRA reassessment?

when i recieved the form i was about 100-105 days short of pension the send date was 22nd march and on the 02/042020 i am

i cannot get thru to DWP , but have rung the people who do medicals , he was simpathetic and almost helpful , if i FAIL to return form they will stop benifit , he could not give much more info as he didnt know what was happening0 -

Yes, i also received one to be sent back by 13th April. I was hoping i would have heard from them extending the time to return it but haven't heard anything at all. No idea how or why they expect us to return these forms with everything that's going on! It's ridiculous! I haven't even started filling it out yet
I don't think there's any scope for the assessment provider to allow longer to return a form other than if a file is marked as someone being a vulnerable person with mental health problems. In that case the person can take as long as they want as the claim can't be suspended or closed and can only be progressed by a face-to-face appoiuntment.The DWP should have done what they've done with PIP. Everyone has been given an extra 3 months to return their PIP reassessment forms. And even then there's a three to six month backlog before the PIP form will be dealt with. I'm not sure what the current backlog is for the AP looking at ESA forms.

It's the date of the review that matters not when the form was sent out. The form is supposed to be sent out about 8 weeks before the review date (or to use the DWP official term, the prognosis date). Either there has been a backlog in your area which means the form was sent out later than it should have been or your review date is within three months of you reaching SPA. Interesting, do you have a source for that? sorry I do not know "review date"but as you say "8 weeks before" , would take the letter i have here to read 22 may? (8 weeks after letter?) in which case that would be less than 2 mths before state pension
I know this is someone elses thread (sorry to jump in) , counsil help , who i phoned suggested i ring dwp on 17th and ask for extension , but reading shows , they do not give them , guy at medical assesments "underlined" "must be returned by"
unlike previous yrs , i,m not to bothered either way and if it comes to it . i will stand income for a month *
*job centre not bothering people once signed on for maybe 6 mths?

sorry last question , as you know dwp impossible to contact , however they are answering phone at assesment centre , will they know review date , can they do anything or is this all down to dwp0

The date is arrived at by the Decision Maker at the DWP taking into consideration the recommended period of time that the assessment provider gives when completing the assessment report after a face-to-face assessment or a paper based assessment. It runs from the date of the assessment. So if you had an assessment on, say 1 April 2020 with a one year review date recommendation your review / prognosis date would be 1 April 2021.In order to ensure that the Work Capability Assessment is undertaken on time the DWP usually send out the ESA50 about 8 weeks before that date. This is to give time for the ESA50 to be sent out, returned, to give the assessment provider time to check the form, arrange an assessment and get the report back to the DWP (in theory this should work but it sometimes takes longer for the whole process to run from start to finish). The DWP don't always start the process on time so while the ESA50 should be sent about 8 weeks before hand backlogs can mean that they are sent out a bit later than they should be.If the DWP were up to date, your ESA50 being sent on 22 March would suggest your review date is about 8 weeks after that, and well within 91 days of you reaching state pension age. It is possible that your review date is before 4 April and the DWP were just a bit slow in sending out the ESA50. But you'll not know until you can speak to someone at the DWP. The assessment provider won't have that sort of information, it's held on the DWP ESA computer system.0 -

Excellent, I'm so glad you mentioned that, thanks!I notice there''s Q and A's on that link and i seen this ..Q. Can I be found Fit for Work (fail the Work Capability Assessment,) without having attended a face to face assessment?
A. Yes, the decision as to whether you are Fit for Work will be based on a paper or phone assessment. There is no requirement in law that says that the health care provider must carry out a face-to-face assessment.Surely that's incorrect? They can't find you fit for work without a face to face assessment?
