Furlough Help

My partner has been furloughed. He is paid hourly and almost doubles his basic pay every week due to overtime. It was our understanding that the furlough pay would be calculated on his average earnings but his company have stated they are just calculating it from basic pay, are they able to do this?

The company can choose to vary your contract of employment, including pay, however they choose (within the law), but you have to agree. The company should read the guidance to employers here:

I suggest you print it off and ask why they can't calculate the amount they will receive using the variable pay rules, which seem appropriate to you (according to Martin Lewis's advice).
If they increase the claim in this way, they have to pass it on to you. They cannot pay you less than the pay they claim in respect of you.0
