    claiming the Furlough money back from the government is retrospective at the moment. so they would know if any work had been done or not, before they claim.

    What are you struggling with? What is not black and white?. Read the guidance, in particular :
    Both you and your employer must agree to put you on furlough - so speak to your employer about whether they can claim. Once agreed your employer must confirm in writing that you have been furloughed to be eligible to claim. Contact your employer if you do not receive confirmation.

    Agreeing to furlough employees

    Employers should discuss with their staff and make any changes to the employment contract by agreement. When employers are making decisions in relation to the process, including deciding who to offer furlough to, equality and discrimination laws will apply in the usual way.

    To be eligible for the grant employers must confirm in writing to their employee confirming that they have been furloughed. A record of this communication must be kept for five years.

    You do not need to place all your employees on furlough. However, those employees who you do place on furlough cannot undertake work for you.

    That must mean an employee must be informed before they are placed on furlough, not after the event if only then it suits the employer.
