Very debatable I'd have thought. In any case they will doubtless say that they told you that your holiday would count as part of the garden leave. Try it on if you feel it is the right thing to do. They may just pay, they may fight and if they do you may win but in my opinion you will more likely lose. I trust you won't ever need a reference from them.......0 -
