boss said friday 27th march we are closing and being put on furlough now they want us back?

Hi my employer said on friday we were being put on furlough after our shift finished. i had a text today that they want us back on thursday 2nd april. i get paid weekly and my wageslip doesnt say furlough. i recored the metting as to when he said all the above, what is our rights do we have to go back?

any help would be great thanks.

    I would think that they could definitrly get you to go back if you are a keyvworkee
    make the most of it, we are only here for the weekend.
    and we will never, ever return.
  • of course i want to go back, we are a factory that makes stationary so not a key worker. they told us that we would only be asked back if they got the go ahead from the nhs to make masks, but they want us to come back to do other work. and they also have only given us 2 days notice.

    Being on furlough is at the discretion of the employer as they are forking out wages in the expectation of getting it back. It is only an insurance product like car insurance. It does not change your job.

    What are your concerns?
    • All land is owned. If you are not on yours, you are on someone else's
    • When on someone else's be it a road, a pavement, a right of way or a property there are rules. Don't assume there are none.
    • "Free parking" doesn't mean free of rules. Check the rules and if you don't like them, go elsewhere

    You have the right to be paid your contractual hours from Friday as you were not furloughed.
    With regards to their request, you have the right to go back as requested, or to leave the job. They can decide not to furlough if they wish (factories haven't been forced to close so it does not matter whether you are a key worker or not).

    There are a few things we need to know that we don't. What was your employment status at the point you were stood down?
    How are you employed? Do you have contracted minimum hours?

    If they are recalling you then go back if you can get to work safely and work in a safe environment following all health guidelines.
    If your employer furloughed you on 80% then want you back then you can expect to be paid that for the time not worked. Or, expect full pay for contracted hours.
    The employer cannot claim your wage back from HMRC if you are not eligible - and that includes a minimum period of 3 weeks. But that should be their problem. They may need to cover your wage without being able to access the grant under the scheme if this is what they decide to do.

    Depending on contract they will need to cover the 2 days at normal pay. They can not claim for that 2 days. But they can call you back. You have no rights to say if you want to be paid.
