Furlough payment from previous employer?

My Son left his old job and received his last wage on the 11th March, he was due to start a new job with BA on the 16th March however they canceled his contract the day before taking up this position. I heard on Martins TV programme that a woman in a very similar position could ask her previous employer to in effect take her back on for the 3 months and the Govt would pay up to 80% of wages. Is this correct and if so could you give details of next steps please?  I have the audio from the programme but sadly cannot upload, due to page restrictions.

    Hi DaveCOAST

In this instance, it is possible - at the discretion of the business - as he was employed on the 28th Feb.

However, I must stress this is at the discretion of the previous employer and that the re-hiring is in effect for those employees who have been laid off as a result of the business struggling with COVID-19. In this case, your son left the employment and didn't get the new job - therefore it really doesn't qualify. It is a big ask for a company to take someone who has left of their own accord back on, and to pay wages they have to claim back, when that employee will be leaving afterwards too.

In this instance I would advise that your son's best course of action would be to apply for UC as an unemployed person and keep the communication channels open with the new employer.

  • Hi
I resigned from my position as a dental nurse and left on 28th February. I was to start at a new practice on 31st March. I contacted my previous employer to ask if I could be furloughed this was declined. I was told that if I had been made redundant it would be at the employers discretion however there is no clarification on what happens in the case of an employee who has resigned on other grounds !
I was just wondering if there actually is any clarification and if it’s just they won’t rather than can’t ?
    Many thanks

To me it is rather clear they can’t but lots of people are reading it differently to me and think you can.  I will let you interpret it yourself.
  • I was made redundant on Jan 31st and started my new position on March 3rd, My employer was intending to Furlough me (as they have done for the entire workforce) and now informs me that they can't as i was not employed on Feb 28th. I should contact my previous employer and request that they Furlough me. The most recent "employer" was DWP via jobseekers allowance. I cannot find any info on what to do from HMRC?

All you can do is look to see what benefits you are eligible for.

I don't think you'll be eligible. You weren't on your old employers payroll on 28th feb either and the guidance only mentions rehiring workers who were made redundant or stopped working for them after the 28th feb.
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride
