Paye Agency worker

Hi
my husband is employed by an agency on Paye basis and he has been told there is no work but that he is not entitled to the 80% retention scheme because he is just an agency worker and has to accrue holidays. He has been doing the same job with this same agency for five years in July. 
Can anyone help please. He has paid paye and national insurance the same as anyone else. And the agency pay employers national insurance. Surely they should be able to do the retention scheme. Anyone know ???

    I am afraid that this is a very common question, and the short answer is that if an employer doesn't furlough you under the job retention scheme, there's nothing you can do, even if the reason they say they can't furlough a particular person, or class of employees, is wrong.

    He needs to refer to his contract with the agency as to what he may or may not be entitiled to.

    But generally, most agency contracts are based on a 'no work - no pay' agreement', although they may have notice periods to be provided either way

    Presumably the agency, being unable to to provide further work, has given notice if applicable. If no notice, at least thge agency should have explained they have no work for your husband, and therefore he should seek work elsewhere.

    Usual state benefits remain for those able and willing to work, but unable to loacte suitable work.

    I don;t know what work your employer does, or what transferables skills he may have, but lots of jobs going in the food chain field currently, either at supermarkets, delivery, or even farms are now starting to seek to take on seasonal workers.
