Sixth Anniversary First Post Combo Breaker

We booked a week in a holiday home on the Isle of Mull (18th April till 25th April 2020) through a local holiday home company, due to goverment rules and restrictions now in place the company can not fulfil this booking and we can not use the booking. They have asked that we look for an alternative date between Sept 2020 and March 2020, however due to other commitments and holidays already planned we can not commit to dates they have offered. We have asked that they refund us in full, however they say; via their website; they can't and we unfortunately have lost our money! I appreciate these are unprecedented times and very strange at that! The holiday was paid in full with a MasterCard, so can we look at Chargeback as an option as the item / service was not supplied?

    Is the company actually providing the accommodation or acting as an agent? If there's a third party between you and the accommodation provider then it would mean Section 75 protection would not apply. Might still be worth asking for a chargeback, but that would be at the credit card company's discretion and the holiday home company may appeal against it. Do you have any travel insurance with cancellation cover that covers this situation?

  • no we don't have travel insurance that covers this as its a UK holiday and our worldwide cover says that UK isn't covered!
    what about under the Consumer rights 2015, they haven't provided the service they said they would???? or am i grasping at straws? they have came back and offered 50% refund. look forward to hearing your thoughts.

    I'm having the same problem.  I'm going to try a chargeback as surely my contract is with Sykes, who are the ones who have said I can't go (it's not until end of May).

    I am not sure re: benjus reply. I am not expert so please dont think I am being rude, but section 75 would surely cover you - put it this way, I am using loveholidays for my holiday and they are in theory an agent between me and my flight (Virgin) and hotel (MGM).
  • I watched an interview on TV the other night with Martin Lewis, he was talking about CHARGE BACK via your Credit card, I have three issues with companies who are not refunding money, John Lewis my credit card company DO NOT WANT to know and say that the information supplied is incorrect
