[Scotland Question] Renting & Buy to Let Mortgage or Not!

I am a tenant renting a property in Scotland where there is a long list of issues with the condition of the property, and how the property is being managed if you can call it that, and the legality of me being here.  I am going to try and take them to tribunal.  I am hoping someone here can help. 

Is there any way to check if the owner has a buy to let mortgage, on the property the condition of the property is dire and it is in negative equity and is obvious this has been the case for years they need to spend tens of thousands to correct them all but won't.  I know the name of the bank they originally took the mortgage out with i'm assuming it would still be the same. 

I'm hoping for constructive comments here, as i'm thinking out loud with this.   Thanks

    Not really. Post coming to the address from the lender would be a clue that it isn't.
    Can't see it would help you anyway. The bank isn't going to be very interested as long as the mortgage is being paid.

    no post comes to the address for the owner, he lives abroad.

    Ok, well that would tend to suggest the lender knows he's not an owner-occupier.

    hmm i am dubious i find it hard to beleive that he would tell them he does not live there. Could he have informed them that he moved elsewhere but was not renting the place out?  as i doubt there is any insurance on the property, if there was he should have used it on the repairs.

    Does it matter?  There are plenty of things you can take your landlord to tribunal for including repairs, or rather a lack of, but the relationship between the landlord and his/her mortgage lender is not one.  Your landlord might not even have a mortgage anymore and even if there is one the lack of post going to your home address would strongly suggest that they are aware your landlord does not live there.  Even if your landlord did have a residential mortgage without consent to let what do you think that would have to do with the legality of you being there?  Not having a licence would be a criminal act but the wrong type of mortgage would not be.

    An unoccupied property would be an even greater risk for the lender than there being a tenant in it. As above, why are you interested in the mortgage? 

    Are any of the defects to the property caused by things which are likely to be insured risks? Insurance doesn't cover normal deterioration, just specific events like storm damage, burst pipes, fire etc.
