    It's like trying to prove that you haven't received a delivery if you haven't got a tracking number,  it's impossible.

    What should happen is the other party prove that the goods/ services  were provided.

    I didn’t end up going down this route in the end.  Eurotunnel’s tweets in May referred to reduction to one service per hour (usually four or more I think), on the back of new French regulations, which I would argue is a partial suspension, and should be dealt with as identified in the terms.

    Also, importantly the terms deal with the situation where carriage cannot be carried out within a reasonable timeframe. This is NOT the same as cancelling entire trains. It relates to carriage of YOUR vehicle/passengers, and ET are now saying carriage cannot occur unless you’ve got new paperwork that is impossible for you to provide.  Again, the conditions of carriage set out what should happen. 

    I suggest you tell the credit card company that the terms of the agreement set out that a refund should be offered where they cannot complete your carriage within a reasonable period of time. Maybe email them the link to the conditions of carriage and highlight these clauses.

    Ultimately they might not have the resources to look into it though, and may err on the side of staying out of it. If determined, you could then escalate to the FOS, or escalate your Eurotunnel complaint to their regulator/ombudsman. 
  • Just to rub salt into the wound I notice this on the Eurotunnel website “So that you can book with confidence, our standard tickets booked between the 1st and 17th of June for travel before 15th September 2020 are now refundable; no questions asked.” What about the ones booked in January you money grabbing ....I wish somebody would sort them out.
  • I wondered if anybody did manage to get a refund for a srandard ticket?Since  the FCO are updating their exempt list and will be removing The Netherlands we can't go on our planned trip to visit family. Any advice on getting a refund would be welcome. I've looked at the terms of carriage, as previously advised on this thread. I assume Eurotunnel will say that changing FCO advise isn't covered....but I shall try.....🤞
  • Just found this thread after looking for some advice.
    I wondered why I couldn't select a date after the end of next Jan to change my booking to and now realise that this would fall past the year from original booking. 
    I have moved my booking twice already due to lockdown and not being able to travel to France for a day/overnight trip without having to isolate for 14 days at either end. 

    Now it looks as though I will lose the money altogether and still no chance of a trip in sight. 

    Has anybody managed to get a refund on a non refundable ticket? 
  • Yes - but the key element is that we are in Wales, and so it was straightforward illegal at the time for us to have travelled.  Had it not been for that then I have no doubt we would not have got the refund.  The Competition and Markets Authority view is that the contract was Frustrated under the (1943) law - and that was the approach that I took.
  • Me and my friend are having exactly the same problem. We booked in August, 4 days before the FCDO blocked travel to Austria, our booked destination in January/Feb 2021. I've exchanged 4 emails and they just blunt repeat we can travel up to August 16th. If FCDO advice still blocks travel in 2021 up to this date, they are still refusing to offer a refund or even a credit note. To be honest I'd be happy with a credit note for next year's ski trip but they refused.
    Personally I think it's a poor show from a company, and I see they pulled out of all the regulatory bodies so they can do what they like.
