the burden of proof is on myself to demonstrate they are brokenI believe the burden of proof (especially if it gets to court) is on the PPC/Gym to prove they were working.2

And one more time for luck: COMPLAIN like hell to landowner. That is the first thing everyone is advised to do & it often works.
Edit: just seen that you've tried. Keep trying, annoying as it is. Up the anti with the tone & content of emails.3 -
Unfortunately, the gym has sent a generic out of office reply and they won't answer the phone. It has been shut due to Covid-19. Looks like I will have to contact my local MP but don't imagine they will respond quickly enough, so will have to send the blue template appeal. So frustrating!1

Keep a copy of your e-mail, the gym's reply and keep a copy (screenshot maybe) of your SENT folder showing you tried your best to mitigate the situation.1

If the car park is within the "one form of exercise per day" allowed at the moment, then walking there and taking pics as part of that exercise would I believe be within the spirit of the lockdown, as long of course that it is safe for you to do so.
Frustration of contract will be one of your appeal points at PoPLA because the ticket machine was faulty.

Did you contact the gym's manager? While he or she may not be at work right now, is the gym part of a chain? I doubt that their head office will be closed completely. Somebody with the authority to cancel the PCN will be keeping an eye on all things gym-related and loyal, grateful patrons have surely just become VIPs ...BrkenFingrs said:Unfortunately, the gym has sent a generic out of office reply and they won't answer the phone. Do they have a website/Facebook/TripAdvisor/good gym page. Perhaps a spanking on there may attract their attention. You never know how far you can go until you go too far.1

Hey guys,
Want to thank everyone for their help and well wishes! Got an email from the company today and they've cancelled the ticket. I had spoken to the gym owner and he asked for a copy of the ticket and stated that he had emailed them to cancel it. As it was close to the 26th day, I sent the blue template just as well to ensure I wouldn't be caught out.
Just heard the good news today (approx two weeks after the owner sent that email). Thanks to everyone for their advice, especially the ones who said to speak to the owner. I think that's the one that swung it!
Kind regards and many thanks!5 -
Yay! And again the advice is working.
'Plan A' with any private PCN (before even thinking about an appeal) is always to complain to the organ grinder, to put their monkey back in its box!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
