Hi Folks
I have the title plan and title sheet of a property in Scotland but there is a section I don't fully understand. Details in quotation marks below. I will attach the title plan so you can see both shaded areas. Essentially the property is 1st floor flat(there are only two floors) the ground floor flat is a council flat with an old lady below and I just want to understand what access I have (if any) to the light blue shaded area. The blue shaded area is a path and a decent sized garden area. But as you will see there are no red boundary lines indicating ownership of any land in that garden(light blue area.
I'm under the impression the blue area is council property and currently I have my bins in the garden but I need to know if I own any of it. Hope you can help
"TOGETHER ALSO WITH (One) a right in common with the proprietor or proprietors of 29 Bankwell Crescent, in and to (First) the mutual pathway and others tinted blue on the said Plan;"
If you need any more info just ask.
Many thanks in advance.

I think it means you own it jointly with the other owners. "Right in common". If you read on through the  may deed there may be more info about responsibilities for maintenance etc. Your solicitor should be able to answer any questions about the title.

You have 50% ownership of all the blue area. Which means you can access all of it.

Many thanks for your help. I thought this might be the case but was unsure about the wording. Thanks again.
